Terms of use

This is an English translation for convenience. The legally binding version is the German Nutzungsbedingungen.

1. Scope

These terms apply to the use of the website “Birthscape”, operated by Mustapha Ait Boukhliq (see Legal notice). By using the website you agree to these terms.

2. The service

Birthscape builds a look back at a given day from public data sources, including a certificate, a poster and a film. All of this is free and needs no account. The only paid extra is Gift Plus (section 6). There is no right to constant availability or to particular features. We may change, limit or discontinue the website at any time.

3. Accuracy

Content is compiled automatically from third-party sources (including Open-Meteo, the Billboard archive, Wikipedia, Wikidata, the World Bank, NASA and Apple). Weather values are modelled for the location, chart data comes from national charts or the US Billboard chart, prices and market figures are estimates, and the star map is a simplified illustration. The content is for entertainment and keepsake purposes. It is not financial, investment or other professional advice, and we don’t guarantee that it is correct or complete.

4. Your obligations

• Use the website only in line with applicable law.
• Don’t enter unlawful or offensive content, or content that infringes others’ rights, in names or gift messages. You are responsible for what you enter and for links you share.
• Only enter other people’s details if they would likely be fine with it.
• Automated mass requests (such as scraping or bots) that could affect the service are not allowed.

5. Using your results

You may use, print and give away the certificate, poster and film for private, non-commercial purposes. Please respect third-party rights:

• Music: the film may contain a 30-second song preview from Apple. The music belongs to its rights holders. Saved videos are for private use only; publishing them (for example on YouTube, Instagram or TikTok) may infringe copyright.
• Text: content from Wikipedia is licensed under CC BY-SA 4.0 and may only be reused under its terms.
• Images: NASA and Wikipedia images are subject to the rights stated with them.

The website’s own design, text and software are protected by copyright.

6. Gift Plus (paid extra)

Gift Plus adds a photo, a voice message and an opening at midnight on the birthday to one gift link, and shows that gift page without ads or shopping links. It is a one-time purchase per gift link, with no subscription. The price is shown before you pay. The order is processed by our reseller Paddle.com, which is the merchant of record for all orders: Paddle handles payment, invoices, taxes and refunds under its buyer terms.

Refunds: if you’re not happy, you get your money back within 14 days of the purchase, no questions asked. Just reply to the Paddle receipt e-mail or write to support@birthscape.com. We keep the photo and voice message for 13 months after the purchase, then delete them; the rest of the gift link keeps working without them. You are responsible for having the consent of the people shown or heard.

7. Liability

For Gift Plus, we are liable under the statutory rules. For everything else, as it is provided free of charge, we are liable only for intent and gross negligence (in line with §§ 521, 523, 524 of the German Civil Code). This does not limit liability for injury to life, body or health, or under the German Product Liability Act. Operators of external websites we link to are responsible for their content.

8. Final provisions

The law of the Kingdom of Morocco applies. If you are a consumer, mandatory consumer protection rules of the country where you normally live remain unaffected. If any provision is invalid, the rest remain valid.
